Labor Team Scores Win for Energy Industry Client before Court of Appeals
Yasthel Gonzalez lead the efforts to get a favorable ruling from the Puerto Rico the Court of Appeals for Island’s largest gasoline wholesaler in case where employee of independent contractor transportation company alleged that she was victim of sexual harassment by an employee of our client. We argued that the claim was time-barred because the charge she filed before the Anti-Discrimination Unit did not toll her claim against our client. The Appellate Court unanimously agreed, concluding that the filing at the Unit did not have a tolling effect on a torts claims against a non-employer party. The communications our client had with the Unit denying an employment relationship did not have a tolling effect for purposes of a torts claim against our client who was not plaintiff’s employer.
